Terms and conditions

These conditions govern the use of Postal Forever and the purchase of a letter. By creating or paying for a letter, you accept what follows. Read them: they are written to be clear, not to hide anything.

1Who sells to you

The Postal Forever service is operated by Hugo Echeverri Jaramillo, identified by C.C. 98.665.959, with address at Medellín, Colombia (“we”). You can write to us at hello@postalforever.com.

Important — who charges you

We do not process the payment. The merchant of record is Lemon Squeezy, LLC: they charge you, issue the invoice, and declare and pay your country’s tax (VAT/GST). Your payment relationship is with them; the creation and delivery of the letter is with us.

2What you buy

A digital commemorative letter: an envelope, a seal, an illustrated letter, a dedication and, depending on the plan, your voice, a video and a photo. It is delivered through a private link, by email and — if you provide it — by WhatsApp. It is a digital product, not a physical object: nothing is sent by postal mail.

3Price, taxes and delivery

  • Prices are shown in United States dollars (USD). Your country’s tax is calculated and included in the payment.
  • It is a single payment. There is no subscription and no later charges.
  • Delivery is immediate once the payment is confirmed, unless you choose a future opening date (Legacy plan).

4Refunds and right of withdrawal

Read this before paying

Because this is digital content delivered immediately, by confirming the payment you expressly request its immediate performance and acknowledge that, once the letter has been delivered, you lose the right of withdrawal and the payment is non-refundable.

This follows article 16(m) of European Union Directive 2011/83/EU and the equivalent consumer protection rules of other countries. If a charge was an obvious error, a duplicate, or the letter was never delivered through our fault, write to us: those cases we do resolve.

5Your content and what you may upload

By uploading text, photos, video or audio, you declare and warrant that:

  • You have the right to use that content and to have it appear in the letter.
  • You have the permission of the people who appear in it or are mentioned.
  • It is not illegal, does not infringe third-party rights, and contains no abusive, hateful, threatening or harassing material.

We may withdraw or not deliver a letter whose content breaches the above, and keep whatever is needed to answer a request from an authority. You are solely responsible for the content you upload; you hold us harmless against any third-party claim arising from it (see point 9).

6Who owns what (intellectual property)

  • Yours: the text, photos, video and audio you upload remain yours. You only give us permission to store and deliver them as part of the service.
  • Ours: the designs of the envelopes, seals, letters and stamps, the name and the presentation of the service. They are not to be copied or resold.

7Legacy letters and opening date

The Legacy plan lets you schedule a letter to open on a future date. Because of its sensitive nature, its own rules apply:

  • While it is sealed, its content is not shown and never travels to any browser.
  • The letter is delivered on the chosen date regardless of what happens after the purchase, save for an order from an authority or a verified request from the person who created it.
  • It may not be used to harass, threaten or contact against their will the person who receives it. Such a letter is cancelled without a refund.
  • The 5-year safekeeping is a best-effort preservation service, not a perpetual guarantee: that is why everything is downloadable from the day it opens and we recommend you keep your own copy.

8Safekeeping, download and end of the term

We keep your letter and its files for 5 years counted from the day it opens. If you scheduled it far ahead, we keep it until that date and 5 years beyond. Before that term ends we warn you three times (15 days, 2 days and 1 day before) so that you can download it. Once the term is over, we may delete it. The copy you download is yours forever and does not depend on this service continuing to exist.

How far ahead you may schedule. The opening may be set at most 25 years from today. We do not accept dates beyond that, and it is not a technical limitation: it is that we do not want to promise what we cannot guarantee. If you need a date nobody can know today — the day someone marries, or the day you are no longer here — the honest way is not a forty-year calendar: it is to download the letter and leave it in the hands of someone you trust.

If we ever have to close

We will not disappear in silence. If this service stops running — for whatever reason — we undertake to do three things: give at least 90 days’ notice to every address we hold; deliver ahead of time every letter that was scheduled, with a note explaining why it arrives early; and keep the download links open throughout those 90 days. A letter that has been paid for is not lost because we close: it is brought forward.

It is the promise we can actually keep, and that is why it is the one we make. No company can guarantee you it will still exist 25 years from now; what we can guarantee is that, if we ever had to close, your letter would go out beforehand and you would have 90 days to download it.

9Limitation of liability

Shielding clause

The service is provided “as is”. To the fullest extent permitted by law, our total liability to you for any claim will not exceed the amount you paid for the letter in question. We are not liable for indirect damages, loss of profit, loss of data, or for failures outside our control (payment, email or internet providers, or the device of the person receiving the letter).

Indemnity: you keep us free from any claim, loss or expense (including legal fees) arising from the content you uploaded or from your breach of these conditions. None of this limits rights the law grants you as a consumer that cannot be waived.

10Force majeure and discontinuation of the service

We are not liable for breaches caused by events outside our reasonable control. If one day we close the service, what we already promised under safekeeping applies: at least 90 days’ notice, early delivery of every scheduled letter, and download links kept open throughout that period. That is the standard, and no other.

11Governing law and disputes

These conditions are governed by the laws of the Republic of Colombia. Before going to court, we ask you to write to us and look for a solution. This does not deprive anyone buying as a consumer in the European Union of the protection of the mandatory rules of their country of residence.

12Changes

We may update these conditions. The version in force is always the one published on this page, with its date. Changes do not affect purchases already made.

These texts protect your relationship with the people who buy from you and meet the frameworks applicable on the date of their last revision. They are not a substitute for review by a qualified lawyer, which is advisable before operating at high volume or in a country with its own requirements.

These terms apply exactly as you read them. We publish them in eight languages and all of them are equally binding: the one that applies to you is the one in your language.
